The Sixth Central Pay Commission (CPC) Report was out in the afternoon and simultaneously the work force in sarkari establishments went into jubilation. Calculators were brought out and the humble pay clerk in the office became the most sought after person to facilitate estimation of how much bucks would flow in whose kitty. Euphoria of this kind is a regular occurrence after announcement of pay benefits but is short-lived till the actual calculations are made. The rapid rise in market prices and also the amazing growth of salaries in private sector soon overtake the government pay scales.
On this occasion the media is all agog with the overestimated projections of benefits and for days together it goes on repeating the imagined negative impact on the national economy. The media forgets the fact that journalists also look forward for wage increase and as compared to the increase in every other sector the Government servants get a modest jump in pay every ten years . It is also forgotten that the economic impact on budget which is sought to be over hyped is the only decadal benefit offered to millions of families of government servants who are also fellow countrymen and have a right to share the national wealth.
A quick glance at the report and projected pay scales (now referred to as pay bands) shows that on an average a government servant would get additional financial benefits which would be in the range of 40% of the existing basic pay. Even the top salaries of Secretary in Govt. of India and Cabinet Secretary which appear to be quite high in real terms are likely to increase to that extent only.
The real indicators of improvements in working conditions as reflected in the report of the Pay Commission are the measures suggested to take care of female employees, group D employees, physically challenged employees and the pensioners. The Commission has also suggested improvements in the allowance and compensation packages for army men. For healthcare it has proposed Health Insurance Schemes at places where CGHS facilities are not available.
For the women employees the facility of maternity leave is extended to six months against existing three months and concept of flexible working hours has also been brought in. The suggestions if accepted would certainly be considered as a very progressive gesture on part of a caring employer.
In respect of the lowest paid employees presently classified as Group D employees the Commission has suggested their upward mobility to Group C in case they fulfill the educational qualifications . Those who do not possess the requisite qualifications are proposed to be trained to rise to Group C in due course of time. The Commission seeks to transform them into multi skilled persons. Attention of this nature on workforce on the lowest rung of ladder was also long overdue.
For the physically challenged employees the concept of flexible working hours has been introduced. The Commission has also proposed measures which would facilitate their access to good quality aids and appliance which would help them overcome the respective disabilities in a better manner. Other benefits which have been proposed are higher rate of transport allowance and subsidy in the loan for purchase of car @ 4%.
Retiring Govt. employees can now expect a higher quantum of gratuity (an amount equal to 15 Months emoluments at the retirement stage). The ceiling of Rs. 3.5 Lakhs has been proposed to be raised to Rs. 10 Lakhs. Another innovative measure suggested for helping the retired employees is increase in pension at various stages between 80 to 100 years of age. It is proposed to increase the benefit @ 20% for 80 year olds and thereafter @ 20% for each slot of subsequent 5 years. This has been justified on grounds of increased expenses on medical facilities in old age and is a very well thought gesture.
For improving the morale of army men additional compensation in case of casualty has been proposed. The Commission has also suggested additional pay for those in line of service.
As a part of system improvement the daily allowance for officers on tour has been made more realistic so that the govt servants on duty can stay in comfort. Officers availing LTC have been permitted air travel if they are entitled for the same for official tours. Leave encashment procedure for LTC has also been liberalized.
The major indicator of structural reforms made by the Commission is reduction in the number of pay scales . The Commission has also introduced the concept of pay band by clubbing a number of scales into a long running scale with grade pay as mark of identification of seniority. The Commission expects to iron out several anomalies by introduction of this concept. Another new concept introduced by Commission is concept of differential increment rate based on performance. Unlike other measures this suggestion may not be met with enthusiasm since performance appraisal in public services is still a grey area which is not yet truly modernized.

The report is not yet accepted by the Govt. May be another 2-3 months before we know as to which recommendations are accepted.The report of CPC is for Central Govt.Employees. Private sector employer has no compulsion to give the same benefits to it’s employees.Depends on the contract between the employer and employees.

I will be retiring on 31st Dec. 2008 from a State Govt. PSU and come under the lumpsum scheme. Therefore, I dont stand to benefit the pension that will be announced by the 6th Pay Commission. Hence, this appeal to the State Govt. to kindly raise the Gratuity amount from Rs.3.5 lakhs to Rs.10 lakhs to enable me to cope up with my old age as during the last many years our salaries have been frozen due to the bargaining councils negotiations with the Management.

i am a retired person. retired on 30-6-08. My basic pay as on 1-1-06 is Rs.8700 in the scale of Rs.6500-10500. Dt.of increment 1st May. Basic pay Rs.8900/-on 1-5-2006. According to the following calculations made, a retired Central Government Group A Officer will get an increase of only 19.06% as on 1-1-2006, and 9.15% as on 1-1-2008 in his Pension!
A Group A Officer [Retired on 31-5-2004] was drawing a Basic Pay of Rs.11,950+DEARNESS PAY 50% +DEARNESS ALLOWANCE 11 % in the Scale of Rs 10,000-325-15,200 with effect from 1-4-2004.Based on the Average Emoluments ,his Pension was fixed as Rs 8,768 +DA 11% of Rs 8,768/-from 1-6-2004.After commutation of 40% of Pension viz,Rs 8,768/-[Rs.3,507/-] his residuary Pension was Rs 5,261/-+DA 11% of Rs 8,768 wef 1-6-2004…What he got on 1-1-2006 was Rs 7,365 /[Pension Rs 5261+DA Rs2104 [24% of Rs. 8,768]
According to the Central Pay Commission’s Recommendations, ,his basic Pension viz,Rs 8768/- has to be raised to 40% wef 1-1-2006.That will be Rs 12,275/-.For this, there will be no DA [from 1-1-2006 to 30-6-2006] according to the Pay Commission.The actual increase he will get on 1-1-2006 is Rs 1,403/-[12,275-3,507=8,768-7,365].This increase is only 19.06% of Rs 7,365/-from 1-1-2006 and not 40% as widely publicized!
According to the Recommendations of the Central Pay Commission, the percentage of DA wef 1-1-2008 is 12%.This Retired Officer will get a Pension of Rs 8,768/-[ 12,275-3,507]+ Rs 1,473 [12% DA of Rs 12,275].The total amount he will get as on 1-1-2008 will be Rs 10,241/-At Present, he is getting Rs 9,382/-[Pension Rs 5,261/-+DA Rs 4,121[47% of Rs 8,768,the Original Pension]
The increase he will get from 1-1-2008 is Rs 859/- [Rs10,241-Rs9,382] which is only 9.15%. It is not known as to how the much publicized 40% increase has been worked out by the Central Pay Commission as well as the Central Government while the actual increase is only 19.06% as on 1-1-2006 and 9.15% as on 1-1-2008!
Will the Central Government look into the Reality?
Its very important for me to now what would be pension of someone retired as Subedar Major from Indian Army in 1995 ater 6th pay commission.

HAS THE CENTRAL GOVERNMENT DONE JUSTICE TO THE PENSIONERS?
The much awaited orders of the Central Govt revising the Pension of millions of Central Govt Pensioners have been issued in Memorandum F NO 38/37/08-P&PW[A] DT.1-9-2008 of the Ministry of Personnel,Public Grievances and Pension which is available in the website pensionersportal.gov.in. From the Pension Fitment Table available in the Memorandum, it is observed that only 50% of the Basic Pay [excluding 50% Dearness Pay effective from 1-4-2004] is taken as the Basic Pension .This Basic Pension is multiplied by 1.86 and 40% of this Basic Pension is added. This is the Consolidated [Revised]Pension with effect from 1-1-2006.
This Consolidated [Revised] Pension should not be less than 50% of the Minimum of the Corresponding Revised Pay Scale+Grade Pay according to the Pay Commission.It appears that in fact, these wordings have no effect at all with the Revised Scales of Pay corresponding to the Pre Revised Scales of Pay.
I desire to furnish a sample case for study.
An Officer drawing a Basic Pay of Rs 11,950/- in the Pay Scale of Rs 10,000-325-15,200 retired on 31-5-2004 is drawing a Basic Pension of Rs 8768/[including Dearness Pay] from 1-6-2004.The Commuted Amount from Pension is Rs 3507/-.The Residuary Pension is 5261/-.He was drawing Rs 7364/-from 1-1-2006 [Rs 5261+DA Rs 2103 [24%of Rs 8768/-]
The Pay Commission/Govt has taken 50% of Rs 11,950/- as Basic Pension and multiplied it by 1.86.[Rs5975x1.86].This comes to Rs 11,114/-.With this 40%[Rs 2390/-] of the Basic Pension , the Revised Pension of Rs13,504/-is arrived at..The Pay Commission /Govt has made it as Rs 13,505/-.
After deduction of the Commutation of Rs 3507, the Residuary Pension is Rs 9998/-from 1-1-2006..For the Revised Pension of Rs 13,505,there will be no Dearness Allowance from 1-1-2006 to 30-6-2006.The increase is Rs 2634/- [Rs 9998-7364] as on 1-1-2006.
WHAT IS THE ACTUAL PERCENTAGE OF INCREASE AS ON 1-1-2006 TO THE PENSIONERS?
It is only 35.7 % [2634×100/7364] as on 1-1-2006 and not 40% as much publicized by the Central Govt!
THE UNJUSTIFIED REVISED DA FORMULA WITH EFFECT FROM 1-1-2006!
Because of the unjustified Revised DA Formula of the Pay Commission, this increase of Rs 2634/ is not having cumulative effect but decreases to Rs 2464/ from 1-7-2006, Rs 2484/from1-1-2007, Rs 2327/from 1-7-2007,Rs1621/ from 1-1-2008 and Rs 2161/ from 1-7-2008! In this case,the existing Pension is Rs 8768/ and the Revised Pension is Rs 13505/-.We may approximately put the ratio as 2:3 and the increase in Pension is one third.Hence,the Percentage of existing percentage of DA should be reduced by one third or 33%.Has it been done accordingly?
Let us see below.

2% from 1-7-2006, 4%from 1-1-2007,3%from 1-7-2007 and 3% from 1-1-2008.
How then the DA was reduced to 2% instead of 3.5% from 1-7-2006, to 3% instead of 4% from 1-7-2007 and 3% instead of 4%?
So,the % of DA as on 1-1-2008 should be 15.5% and not 12%.We do not know the actual Prerevised % of DA as on 1-7-2008..The Correct DA formula should be fixed by the Central Govt.

It is only 35.7 % [2634×100/7364] and not 40% as publicized by the Central Govt!
According to Calculations made, the arrears work out to Rs 78,430/ from 1-1-2006 to 31-8-2008.
WHAT WILL BE THE POSITION OF AN OFFICER DRAWING THE SAME PAY IN THE SAME SCALE WHO RETIRED ON OR AFTER 31-1-2006?
The Corresponding Revised Scale for the Pre Revised Scale of Rs 10000-325-15200 is 15600-39000 plus Grade Pay of Rs 6600/. His Pay will be fixed at Rs 28,830 [Rs22,230 plus Grade Pay of Rs 6600].as per Finance Ministry OM FNO1/1/2008 IC dt 30-8-2008.
He will get a Pension of Rs 14,415/- from 1-2-2006. He will get Rs 910/- more than the Officer who retired just before 1-1-2006!
WHY THIS DISPARITY WITHIN THE SAME SCALE?
WILL THE CENTRAL GOVT LOOK INTO THE ABOVE POINTS AND DO JUSTICE?

WHY THE DISPARITY IN PENSION WITH EFFECT FROM 1-1-2006 AND DENIAL OF NATURAL JUSTICE TO THE POST 1-1-1996 AND PRE 1-1-2006 PENSIONERS BY THE VI CENTRAL PAY COMMISSION AND THE CENTRAL GOVERNMENT?
1. PARITY IN PENSION OF THE PRE AND POST 1-1-1996 RETIREES AND NATURAL JUSTICE TO THE PRE AND POST 1-1-1986 PENSIONERS BY THE V CENTRAL PAY COMMISSION AND THE THEN CENTRAL GOVERNMENT!
The main demand of the Past Pensioners [Retired before 1-1-1986] was for full parity in pension to those who retired during the period from 1.1.1986 onwards. The V CPC in Para 137.13 (PP 1830) had observed as under:-
“While it is desirable to grant complete parity in pension to all Past Pensioners irrespective of the date of their retirement, this may not be feasible straightaway as the financial implications would be considerable. The process of bridging the gap in pension of Past Pensioners (Pre 1986 Pensioners) has already been set in motion by the Fourth CPC when past Pensioners were granted additional relief in addition to consolidation of their pension. This process of attainment of- reasonable parity needs to be commuted so as to achieve complete parity over a period of time.”
In Paras 137.13 and .14 of their Report the V CPC stated that as follow-up of our basic objective of parity, we would recommend that pension of all the Pre 1986 Retirees may be updated by notional fixation of their pay as on 1.1.86 by adopting the same formula as for the serving Employees. This step would bring all the Past Pensioners to a common platform or on the IV CPC pay scales as on 1.1.86. Thereafter, all these Pre 1986 Pensioners can be treated alike in regard to consolidation of their pension as on 1.1.96 by allowing the same fitment weightage as may be allowed to the serving Employees.
The Recommendation of the V Central Pay Commission in making Parity in Pension of Pre and Post 1-1-1996 Retirees and Revising the pension of Pre and Post 1-1-1986 Retirees suitably was accepted and implemented by the then Central Government with effect from 1-1-1996.
Had not both the V Central Pay Commission and the then Central Government had done JUSTICE to the Pre and Post 1-1-1986 Pensioners!
2. DISPARITY IN PENSION BETWEEN THE PRE AND POST 1-1-2006 RETIREES AND INJUSTICE TO THE PRE 1-1-2006 PENSIONERS BY THE VI CENTRAL PAY COMMISSION!
The Disparity in Pension betwwen the Pre and Post 1-1-2006 Retirees and the injustice done by the VI Central Pay Commission and the Central Government to the Post 1-1-1996 and Pre 1-1-2006 Pensioners can be clearly understood by the following facts.
A. Fixation of Revised Pay and Pension in respect of Four Post 1-1-2006 Retirees is given below as per OM FN01/1/2008-IC dt.30-8-2008 and OM FN038/37/08P&PW[A] dt.2-9-2008 of Ministry of Finance,Govt of India.
a.Pre Revised Scale:5500-175-9000 [S10]
Corresponding Revised Scale:9300-34800+Grade Pay
i.Basic Pay:Rs 5500.
Revised Pay: Rs 14430 [10230+4200]
Pension:Rs 7215[50% of Pay]
Pension:Rs 8195[50%of Pay].
b.Pre Revised Scale:10000-325-15200 [S19]
Corresponding Revised Scale:15600-39100+
Grade Pay Rs 6600[PB3]
i.Basic Pay:Rs 10000.
Revised Pay:Rs25200 [18600+6600]
Pension:Rs12600[50% of Pay]
Revised Pay:28830 [22230+6600]

B.Fixation of Revised Pension of Pre 1-1-2006 Retirees by the VI Central Pay Commission as per Memorahdum FNO 38/37/08-P&PW [A] dt 1-9-2008 of the Ministry of Finance,Government of India
The formula fixed by the VI Pay Commission for arriving at the Revised Pension is as follows.
Basic Pay without DP x1.86+40% of the Basic Pay.The Condition is that the Revised Pension should not be less than 50% of the minimum of the Corresponding Revised Scale+Grade Pay.
This Formula could be applied only to Pre 1-1-1996 Retirees.But the Condition that the Revised Pension should not be less than 50% of the minimum of the Revised Pay and Grade Pay cannot be applied to them since they are not covered by the Pay Scales effective from 1-1-1996.
So,the Pay Commission has really intended to apply this formula only to Employees retired from 2-1-1996 to 31-12-2005.
According to the Pay Commission, we are to find out the Corresponding Pay in the Revised Scale by adding the Grade Pay.After finding out the Corresponding Pay,we have to work out 50% of the Revised Pay which will be the Revised Pension effective from 1-1-2006. But the Condition has been wronly worded as ‘The Revised Pension shoud not be less than 50% of the minimum of the Revised Scale+Grade Pay instead of ‘The Revised Pension should not be less than 50% of the Revised Pay + Grade Pay’
So,the Condition has to be modified suitably.
Here,two illustrations are given in respect of Revision of Pension of Four Pre 1-1-2006 Retirees.
1.Basic Pay: Rs 5500.
Pension:Rs. 6215 [2750 [50% of Basic Pay]x1.86+40% of Rs2750]
2.Basic Pay:Rs 6550.
Pension:Rs.7403 [3275[50% of Basic Pay]x1.86+40% of Rs3275]
3.Basic Pay: Rs 10000.
Pension:Rs11300 [5000 [50%of Basic Pay[x1.86+40% of Rs5000]
4.Basic Pay Rs 11950.
Pension:Rs13505.[5975 [50%of Basic Pay]x1.86+40% of Rs 5975]
According to the formula of the Pay Commission, a Pensioner drawing a Basic Pay of Rs 6550 in the Scale of Rs 5500-175-9000[S10] will get only 50% of the minimum of the Revised Scale[Rs 9300-34800-PB 2]+Grade Pay of Rs4200 viz,Rs 7215 and not Rs 8195[Revised for Post 1-1-2006 Pensionner] as Pension!
Similarly,a Pensioner drawing a Basic Pay of Rs 11950 in the Scale of Rs.10000-325-15200 [S19] will get only 50% of the minimum of the Revised Scale [Rs 15600-39100-PB 3]+Grade Pay of Rs 6600 viz,Rs 12600 and not 14415 [Revised for Post 1-1-2006 Pensioner]as Pension!
Why the Pay Commission and the Central Govt have done injustice by applying double standards to the Pre and Post 1-1-2006 Pensioners who belong to the very same Pay Band?
